It generally caps loans covered by the Act, including title-secured loans made by CILA licensees, at 36%. The rate is calculated using the Military Annual Percentage Rate methodology, which captures more loan-related charges than a conventional interest-rate figure.

Loans made in violation of the PLPA’s rate limit can be null and void, meaning the lender may have no right to collect principal, interest, fees, or other charges.

Before the PLPA, Illinois title loans commonly carried rates well above 100%. Research from the Woodstock Institute found that many high-cost lenders left the Illinois market following the law’s introduction and estimated substantial annual savings for Illinois consumers.

In short, Illinois went from allowing very high-cost title lending to imposing one of the country’s tighter rate restrictions.

How the 36% Rate Is Actually Calculated

Illinois uses the federal Military Annual Percentage Rate, or MAPR, methodology when calculating the PLPA’s 36% limit.

MAPR can include certain charges that might not be reflected in a conventional interest-rate figure, such as some fees and credit-related products. This is designed to prevent lenders from complying with the headline rate limit while adding separate charges that substantially increase the real cost of borrowing.

Loan Limits and Borrower Eligibility

Maximum Loan Amount

Under the Consumer Installment Loan Act, a licensed lender can generally make loans with a principal of up to $40,000.

That does not mean every borrower can obtain a $40,000 title-secured loan. The amount available will depend on factors including your income, the required payment structure, underwriting, and the value of the vehicle securing the loan.

Income-Based Payment Restrictions

Your lender also has to consider whether the scheduled payments fit within Illinois’ title-secured lending limits.

Under current Illinois administrative rules, your scheduled monthly payment of principal and interest can’t exceed 22.5% of your gross monthly income.

So if you earn $2,000 a month before taxes, the scheduled principal-and-interest payment can’t exceed $450 a month.

The lender must also verify your gross monthly income using appropriate documentation. That can include sources such as recent pay stubs, tax or W-2 information supported by evidence of current income, government benefit documentation, pension information, or another commercially reasonable method permitted under the rules.

Loan Structure Requirements

Illinois title-secured loans have to be fully amortized and repayable in substantially equal instalments.
